These Terms of Service ("Terms") govern your access to and use of Swap This Link, including our website, application, marketplace, ticket chat, and related services (collectively, the "Service"). By creating an account, browsing, using, or paying for the Service, you agree to these Terms.

1. Who We Are

2. Eligibility and Account Registration

You must be at least 18 years old and legally able to enter contracts. You must provide accurate, complete registration information and keep it current.

• You are responsible for all activity under your account.
• You must keep your login credentials confidential.
• Accounts may require email verification or additional checks before activation.
• We may suspend or terminate accounts that are fraudulent, duplicate, abusive, or unlawful.

3. Service Description

Swap This Link is a software platform that helps users discover potential link partners, propose swaps, communicate in tickets, and track completion.

• Marketplace listings are anonymized until both users accept a swap.
• Admin review is required before user-submitted sites are approved for listing.
• Metrics (for example DA, DR, TF, traffic, referring domains) may be sourced from third-party APIs and may be delayed, incomplete, or inaccurate.
• We provide a platform only. We are not a broker, publisher, SEO agency, legal advisor, or party to agreements between users.

4. Site Submission Rules

You may only submit sites that you own or are authorized to manage.

• Submitted URLs, niches, sensitive niche flags, link types, and notes must be accurate.
• Admins may approve, decline, flag, edit metadata, or remove site listings.
• If a site is declined, we may show or send a moderation reason to the account owner for compliance and quality purposes.

5. Marketplace, Swaps, and Ticket Workflow

You agree to use the platform in good faith and only for legitimate link collaboration.

• URLs remain hidden until both parties complete the acceptance step in the ticket flow, except where visibility is required for your own submitted sites.
• Ticket statuses, chat records, link placement URLs, confirmations, cancellations, and rejection reasons are part of the official platform record.
• Either party may cancel or reject where allowed by the current status flow. We may preserve these records for fraud prevention, operations, and legal compliance.
• A completed swap may be marked as already swapped in marketplace and user views, and may affect future proposal eligibility for the same site pair.

6. Prohibited Conduct

You may not:

• Use malware, phishing, fraud, impersonation, spam, or deceptive practices.
• Submit illegal, infringing, or harmful content.
• Misrepresent site ownership, metrics, traffic, or link placement performance.
• Scrape, crawl, copy, reverse engineer, or bypass anonymization, access controls, or rate limits without written permission.
• Interfere with Service security, uptime, or other users' lawful use.

7. User Content License

You retain ownership of your submitted content and communications. You grant us a worldwide, non-exclusive, royalty-free license to host, process, display, reproduce, and transmit your content solely to operate, maintain, secure, and improve the Service.

You represent and warrant that you have all rights required to submit each site, URL, message, and related data and that your submissions do not violate applicable law or third-party rights.

8. Fees, Plans, and WooCommerce Billing

Paid subscriptions are processed through our WooCommerce store and payment providers, not directly by this app interface.

• Plan limits and features (including free plan swap limits and paid plan access) are defined in-app and may change prospectively.
• Renewals, cancellations, payment methods, taxes, and invoices are managed by WooCommerce and/or payment processors under their terms.
• If your app email and billing email differ, we may require account verification before linking a subscription.
• If a paid subscription is cancelled, paid access may continue until the then-current billing period ends when supported by billing status logic.
• Refunds, chargebacks, and payment disputes are governed by store policy, payment provider rules, and applicable law.

9. Communications and Notices

You consent to receive Service-related communications, including account verification, password reset, security alerts, moderation notices, billing/subscription updates, and ticket notifications. Where required by law, marketing emails include unsubscribe options.

10. Third-Party Services and Data Sources

The Service depends on third-party providers, including hosting, database, email, billing, and domain metric APIs. We are not responsible for third-party outages, delays, policy changes, or inaccuracies. Third-party terms may apply to your use of related features.

11. Intellectual Property

Except for your content, the Service and its software, branding, design, and content are owned by us or our licensors and protected by intellectual property laws. You receive a limited, revocable, non-transferable right to use the Service in accordance with these Terms.

12. Security and Platform Integrity

• You may not attempt unauthorized access to accounts, APIs, tickets, admin features, or infrastructure.
• You may not test vulnerabilities, run intrusive scans, or attack the platform.
• We may throttle, block, suspend, or remove access to protect users and platform integrity.

13. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis.

• We do not guarantee rankings, traffic, indexing, SEO outcomes, or revenue.
• We do not guarantee that swap partners will perform as expected or maintain placements over time.
• We do not guarantee uninterrupted availability, error-free operation, or complete data accuracy.

14. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, or business interruption.

Our aggregate liability for claims arising out of or relating to the Service will not exceed the total amount paid by you to us for the Service in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

15. Indemnification

You agree to defend, indemnify, and hold harmless Swap This Link, its operators, and affiliates from claims, liabilities, losses, damages, and costs (including reasonable legal fees) arising out of your submissions, swaps, violations of law, infringement claims, or misuse of the Service.

16. Suspension and Termination

We may suspend, restrict, or terminate access at any time for security, legal compliance, abuse prevention, payment issues, or breach of these Terms.

You may stop using the Service at any time. Certain provisions survive termination, including payment obligations, data records required by law, disclaimers, limitations, and indemnification.

17. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction where the Service operator is established, without regard to conflict-of-law rules, except where mandatory consumer law requires otherwise.

18. Force Majeure

We are not liable for delays or failures caused by events outside our reasonable control, including internet outages, infrastructure failures, labor disputes, governmental actions, and natural disasters.

We may modify or discontinue features, limits, and pricing, and may update these Terms from time to time.

• Material updates may be communicated in-app, by email, or both.
• Continued use after changes become effective means you accept the updated Terms.

20. Severability and Entire Agreement

If any provision is unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy and any posted policies referenced herein, form the entire agreement between you and us regarding the Service.
